SC orders Justice Karnans medical check, judge hits back with mental test

The court took suo moto congnizance of letters Justice Karnan wrote against Madras High Court and the Supreme Court judges and asked him to tender an unconditional apology. The apex court further said the medical board to be set up by government hospital Kolkata, will have to submit its report in SC on or before May 8.

In April, Justice Karnan had ordered the CJI Justice Khehar and seven other Supreme Court judges to "appear before him".

Venugopal, in response to a query from the bench, said Justice Karnan had vacated his Chennai bungalow.

Claiming that the top Supreme Court judges had allegedly violated the Scheduled Castes and Tribes (Prevention of Atrocities) Act, Justice Karnan had summoned seven Supreme Court judges, including Chief Justice of India JS Khehar, to appear before him on April 28.

In March, the sitting High Court judge had appeared before a 7-member SC bench to answer the charges of contempt levelled against him. "The order passed by me against the seven accused judges is still in force", he said.

"The Supreme Court order is ridiculous and a desperate attempt of the seven accused judges to escape prosecution under SC/ST (Prevention of Atrocities) Act. They are calculated measures to bring down the image of judiciary", he said. This is the first time in many decades that the chief justice would hold sitting during summer vacation, said senior advocate P Wilson.

The Supreme Court earlier in the day ordered medical examination of Justice Karnan on May 4 by a board of doctors, to be set up by a government hospital in Kolkata.

Justice Karnan faces contempt after he named 20 "corrupt judges" of the country earlier this year and sought an investigation alleging corruption in the judiciary.

The bench had gone to the extent of suggesting Justice Karnan, who had defiantly refused to appear before the bench despite summons, that he may file some medical records pertaining to his mental condition. The warrant had come nearly a month after the court had asked Justice Karnan to appear in person and explain why contempt proceedings not be initiated against him.

Karnan even threatened to "pass suo motu suspension order against the Director General of Police of West Bengal, if the DGP functions against my wish".

Karnan is a Dalit and his orders against the judges are based on laws protecting the Scheduled Caste and Scheduled Tribe people.

"Consequently I ask the President of India to recall the bailable warrant illegally issued by the Supreme Court against me and lift non-work allotment ban of portfolio allocation", he said.
